1. Acceptance of Terms
By accessing or using the FTG platform, website, APIs, or any related services (collectively, the “Service”) provided by FTG TKO LLC (“FTG,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
FTG provides a business-to-business (“B2B”) white-label engagement layer for licensed prediction market operators and sports entertainment platforms. FTG is a software technology provider. FTG does not operate as a sportsbook, casino, gambling operator, or prediction market exchange.
3. Eligibility
The Service is intended for use by licensed operators and authorized business partners. Access is currently invite-only. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement in your jurisdiction.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to notify us immediately of any unauthorized use of your account.
5. Intellectual Property
All content, technology, algorithms, software, trademarks, and proprietary systems comprising the Service are owned by FTG TKO LLC and are protected by United States patent, copyright, trade secret, and trademark law. Patent pending. No license, right, or interest in our intellectual property is granted except as expressly set forth in a separate written license agreement.
6. Confidentiality
Certain features, mechanics, and documentation of the Service are proprietary and confidential. You agree not to disclose, reverse engineer, decompile, or otherwise attempt to derive the source code, algorithms, or underlying logic of the Service. Access granted under a non-disclosure agreement (“NDA”) is subject to the terms of that agreement.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service or servers; (d) scrape, harvest, or collect data from the Service without authorization; (e) sublicense, resell, or redistribute the Service without written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FTG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FTG TKO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Texas.
11. Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after any modification constitutes acceptance of the updated Terms.
